Summary

Published in the Official Bulletin No. 4225 of 20 October 1993, the decree remains in force. Articles 1 and 2 provide that the boundaries of delimited centres, peripheral zones, planning groupings and protected agricultural or forest zones are fixed by decree. Articles 3 to 11 organise the master plan (SDAU): a central committee chaired by the planning authority, a local committee chaired by the wali or governor reporting within fifteen days, consultation of municipal councils and approval by decree. Articles 12 to 17 apply the same circuit to the zoning plan, approved by ministerial order. Articles 18 to 27 cover the development plan: the public inquiry is announced twice in two daily newspapers eight days apart and posted at the town hall, observations are recorded in a register or sent by registered letter, and the plan is approved by decree. Articles 28 to 38 deal with alignment orders and the opinions required on building permits (planning services or urban agency, public works along non-municipal roads and the coast, transport along railways). Articles 34 to 37 set the rules for building outside covered zones, with a derogation committee, and Articles 39 to 43 cover general building regulations and road recognition.

What it changes for your project

Project typeWhat applies
Villa, single-family house

Frequently asked questions

Can I build on rural land not covered by a development plan in Morocco?

Yes, under Article 34: the plot must be at least one hectare, the building footprint may not exceed 1/50 of the plot or 800 m², and the height is capped at 8.50 m including superstructures, with the 10 m and 5 m setbacks required by Law 12-90. Smaller plots need the agreement of a derogation committee (Articles 35 to 37).

Who approves a development plan in Morocco?

The plan is prepared by the planning department or the urban agency with the municipalities, reviewed by a local committee chaired by the wali or governor, submitted to municipal councils and to a one-month public inquiry, then approved by decree published in the Official Bulletin (Article 26).
