Summary
The decree applies Articles 64 to 70 of Law 12-90, 63 to 64 of Law 25-90 and 12-4 to 12-10 of the 1960 dahir on rural settlements. Judicial-police status is granted by joint ministerial order to officials of the prefectures and of the decentralised planning services, subject to diploma and seniority conditions; inspectors act within a defined territory and carry a professional card. They monitor sites on their own initiative; on authorised sites with a properly kept logbook they record remediable breaches in it and immediately order the cessation of irremediable ones (height, extra storey, footprint or floor area, use). Reports are dated, numbered and signed, sent to the public prosecutor with photographs, and copied to the local authority, the municipality, the urban agency and the offender. Seizure requires a detailed inventory; site closure involves evacuating workers, posting a notice and sealing the accesses. The demolition committee is chaired by the wali or governor with the mayor, planning and culture services and civil protection. Before demolition, the local authority serves a 48-hour notice to vacate; the committee checks a technical report, an inventory of occupants, notice to neighbours and site safety, and recovers all costs from the offender as a public debt.
What it changes for your project
| Project type | What applies |
|---|---|

Frequently asked questions
Who can inspect a building site and record an offence in Morocco?
Judicial police officers and planning inspectors: officials of the wali or governor, or of the decentralised planning services, appointed by joint order with the Ministry of Justice and granted judicial-police status (Article 3). They act within their territory, carry a visible professional card and may act on their own initiative or at the request of the local authority, the mayor or the urban agency.
How much notice is given before an illegal building is demolished by the administration?
Once the demolition order has not been complied with, the local authority serves a notice to vacate the building and remove its contents within 48 hours (Article 19); after a report of refusal sent to the prosecutor, the building is evacuated and the committee proceeds, after checking the preliminary measures of Article 21. Costs are recovered from the offender (Article 24).
