Practical reading by the architect

Yassine AT-TARASSI, architect registered with Morocco's National Order of Architects (No. 4315), Arc Bati Architecture. This commentary is a practical reading: it is not the official text and does not replace a review of your own file.

Draft under review by the architect.

Summary

A building threatens ruin when its collapse may endanger occupants, passers-by or neighbouring buildings, or when it no longer offers the required solidity because of decay or hazardous ground (article 2). Owners are responsible for maintenance and for damage caused by partial collapse, subject to article 769 of the Code of Obligations and Contracts (article 3). The president of the municipal council issues reinforcement or demolition orders after a technical expertise or a provincial commission report (article 6), setting the works and deadline (article 9). Failing works, the administration or the Agency carries them out at the owner's or the co-owners' expense (articles 13 and 14). Completion is certified by the architect and the mayor declares the end of the danger (article 15). In imminent danger, evacuation, use bans or demolition apply without suspensive appeal (articles 17 and 18); rent stops during evacuation (article 21). Penalties reach one year's imprisonment and 300,000 dirhams (articles 51 and 52).

What it changes for your project

Project typeWhat applies
Villa, single-family house
