Practical reading by the architect
Yassine AT-TARASSI, architect registered with Morocco's National Order of Architects (No. 4315), Arc Bati Architecture. This commentary is a practical reading: it is not the official text and does not replace a review of your own file.
Draft under review by the architect.
Summary
The architect designs buildings and subdivisions, prepares the plans and directs their execution (article 1); where the law requires an architect, only a private practitioner working independently or as a partner may be used (article 3). Practice requires an administrative authorisation after the Order's opinion, Moroccan nationality, a recognised diploma, a clean record and a two-year traineeship (articles 4 to 16). Private practice is incompatible with non-elective public office and with being a contractor, manufacturer or supplier of building materials (article 18). Since Law 106-14 of 2016, architects may form partnerships or companies whose capital is wholly held by registered architects (articles 21 to 21.3); each partner remains personally liable and signs his work (article 26.1). Illegal practice carries two months to two years' imprisonment and fines of 1,000 to 40,000 dirhams (article 28). All architects must be registered with the Order (article 33). Disciplinary sanctions range from warning to suspension and withdrawal of authorisation, with a fifteen-day suspensive appeal (articles 71 to 101).
What it changes for your project
| Project type | What applies |
|---|---|
